Policy for Recruitment of Ex-offenders

Individuals will be asked to provide details of their criminal record at the application stage in the recruitment process or prior to deployment.

NFER guarantees that this information will be treated in confidence and only be seen by those who need to see it.

Further clarification regarding any offences may be sought at the interview stage or prior to deployment.

Where the post in question requires an Enhanced DBS Check the Foundation is exempt from the Rehabilitation of Offenders Act 1974 in respect of those positions.

Candidates applying for these posts are therefore required to declare at the application stage or prior to deployment any charges, convictions, pending prosecutions or cautions which they have had imposed on them, even if they would otherwise be regarded as spent under this Act. 

In the case of motoring offences only drink/driving and dishonesty should be disclosed. 

Individuals involved in the recruitment process will have support from HR in assessing the relevance and circumstances of offences. NFER ensures that the relevant HR staff receive appropriate guidance and training in the relevant legislation relating to the employment of ex-offenders, e.g. the Rehabilitation of Offenders Act 1974.

At interview / prior to deployment, or separately, an open and measured discussion will take place on the subject of any offences or other matter that might be relevant to the position. Failure to reveal information that is directly relevant to the position sought could lead to withdrawal of an offer of deployment.

Any matter revealed in a DBS check will be discussed with the individual before a conditional offer of deployment is withdrawn.

The disclosure of a criminal record, or other information, will not bar the individual from deployment unless those involved in the selection panel consider that the conviction renders the individual unsuitable for appointment.
